What is on the docket for 2024?

Before the nation’s highest court in 2024 are many cases that will set important precedents for our nation. 

The Supreme Court will weigh cases ranging from the ATF’s ban on bump stocks to the legality of Mifepristone, a popular contraceptive pill. 

In June of 2022, six of the court’s nine justices voted to overturn the constitutional right to abortion guaranteed to American women in Roe V. Wade since 1973. 

Since the overturning of Roe, there has been notable angst towards pending decisions from the court.

A conservative bloc of justices has dominated the Supreme Court since the appointment of three justices—Amy Coney Barrett, Brett Kavanaugh, and Neil Gorsuch—during the term of former President Donald Trump.

At least one case will involve Trump. As formerly reported by the Eagles’ Eyrie, Trump is facing two separate federal trials. 

Trump claims that, as a former President, he is immune to federal prosecution as the illegal acts he has allegedly committed were carried out when he was President and are, therefore, official Presidential acts.

Lastly, in the realm of Trump, on December 19, the Colorado Supreme Court ruled that Trump wouldn’t appear on the state’s Republican Primary Ballots as he violated Section III of the 14th Amendment. 

This section states that no one who has acted in an act of insurrection against the United States may serve in public office. In response to this Colorado ruling, the Supreme Court will weigh the constitutionality of the decision.

The Supreme Court agreed to hear a challenge to Mifepristone, an oral pregnancy blocker approved first by the FDA in 2000. Since then, it has faced many legal challenges, including the challenge that caused it to rise to the Supreme Court.

 Judge Matthew Kacsmaryk of the Fifth Circuit Court of Appeals, the court just below the Supreme Court, ruled that the FDA improperly approved the pill.

Judge Kacmaryk’s ruling paused the use of Mifepristone, removing it from shelves across the country. According to Planned Parenthood, a pro-choice organization, Mifepristone and Misoprostol have been used safely with a safety rating of 99%. 

In this case, FDA v. Alliance for Hippocratic Medicine, the Supreme Court may end yet another federal protection of what many consider a right.
In Cargill v. Garland, 2nd Amendment advocates argue that the ATF banning bump stocks, which increase the fire rate of AR style weapons, is unconstitutional. Through their ruling, the Supreme Court could severely limit the power of the ATF regarding its regulation of firearms. 

According to the New York Times, last month the Supreme Court’s conservative Justices seemed speculative of federal agencies regulatory power. A 1984 decision, Chevron v. Natural Resources Defense Council may be overturned which would knee cap the power of the Executive Branch. Agency regulations on things such as healthcare, the environment, and government benefit programs are under threat by the court.

Supreme Court rulings have already influenced elections with the midterms that took place in 2022 being swayed by Dobbs v. Jackson, the case that put an end to protection from Roe v. Wade. 

Now entering the 2024 election season, the nation’s highest court could once more issue rulings that cause yet another large turnout by young voters angered by its rulings.
